Affidavit template South Africa: how to write and commission a sworn statement

What an affidavit is

A written statement of facts that you swear or affirm is true before a commissioner of oaths. Lying in one is a criminal offence.

What to include

  • Your full name, ID number and address
  • Numbered paragraphs, one fact each
  • The oath declaration
  • Your signature and date — signed in front of the commissioner
  • The commissioner's signature, designation, area and stamp

Common uses

  • Lost ID, invoice or certificate
  • Proof of residence
  • Change of name or marital status
  • B-BBEE EME status (use the B-BBEE generator)

Where to get it commissioned

Any SAPS police station does it free. Post offices, banks, attorneys and some school principals are also commissioners of oaths.

Can I sign the affidavit before going to the police?

No. You must sign in front of the commissioner of oaths.

Does an affidavit expire?

There's no general expiry, but many institutions only accept affidavits commissioned in the last three months.
